Abstract

本研究之目的為探討健身中心定型化契約範本之合適性。本研究收集並分析2005年至2010年5月間台灣地區健身業及消費者相關文獻,並深入訪談健身中心業者及消費者,從官方消費糾紛統計數字,以及消費者、業者對定型化契約範本的認知情形、使用狀況、實施評價,探討不同版本定型化契約範本之合適性。研究結果發現:一、2002年版範本,立意良好,但因無法律及行政強制力,業者多採參考方式處理。二、2007年版範本,與應記載與不可記載事項搭配公佈。雖以具強制力,但因指導員考試及履約保證等相關配套措施並未完善,且對於違反者僅能限期改善及公告資訊,業界使用比率不高。另消保會的申訴案件數量並無有減少趨勢,並未達約制及導正的效果。三、2009年版範本,除對2007年版的部分履約保證等部份內容做修正,並配合母法的修正,增列罰鍰部分,從消保會申訴案件數量比例降低及縣市政府複查後結果顯示,2009年修正版本,因配套措施較完全,的確達到了保護消費者的目的。本研究建議將審閱期、口頭承諾、公共意外險、教練及營業場所資訊揭露等事項加入未來修正版本中,則合適性更為周全,可保障立約雙方之權利義務。
The conclusions are, first, the contract form of 2002 is based on good will, but with no compulsory legislation, so merely became reference material. Second, the 2007 form is legally compulsive, but didn’t complete the supplementary regulations, such as contract execution and trainer’s qualification. For those who didn’t follow, there’s no way of punishment but to declare the violation of corporation. So it was not effective on the purpose of directing and conditioning. Third, the 2009 form fixed the leaks of 2007 form, and with the added part of upper law, the parts about fines, the 2009 form fulfilled the goal of protecting consumers better. According to the results above, This study suggests that, the reviewing period, oral promise, , public casualty insurance、trainer and the coach and business location should be revealed and new added into future edition of fitness center standard contract. The following research can take quantitative methods to obtain data for more suitable contract forms.
