以美、德之假新聞網路監管模式探討臺灣假新聞網路監管之挑戰

Abstract

隨著科技技術的日新月異,網路空間的使用已經是人人每天的例行事項,但網路的惡意使用也隨之而來,自2016年美國總統大選以及2019年COVID-19疫情爆發以來,假新聞對世界各國家造成嚴重的傷害。在此情況下,西方國家紛紛開始對假新聞之監管做出對策。與此同時,臺灣也曾於2022年推出《數位中介服務法》草案,希望能透過法案的制定監管臺灣境內網路之假新聞;然而草案因機制問題造成爭議進而使臺灣民眾反彈,《數位中介服務法》草案之推行就此作罷。本研究透過對美國與德國假新聞監管的相關法案做探討與比較後認為,透過參考德國模式對《數位中介服務法》草案進行修改較為適合臺灣目前之社會狀況與需求。
With the rapid development of science and technology, the use of cyberspace has become a daily routine for everyone, but malicious uses of the Internet have also followed. Since the 2016 U.S. presidential election and the outbreak of the COVID-19 epidemic in 2019, Fake news causes serious harm to countries around the world. Under this circumstance, Western countries, led by the United States, have begun to take countermeasures to regulate fake news. At the same time, Taiwan also launched a draft of the"Digital Intermediary Services Act" in 2022, hoping to regulate fake news on the Internet in Taiwan through the enactment of the bill; however, the draft caused controversy due to mechanism issues, which caused a backlash from the Taiwanese people. The implementation of the draft Intermediary Services Law has been discontinued. This study discusses and compares the relevant bills on fake news regulatory in the United States and Germany and believes that modifying the draft "Digital IntermediaryServices Act" by referring to the German model is more suitable for Taiwan's current social conditions and needs.
