都市危險及老舊建築重建業務構思及執行策略

Abstract
為解決早期都市發展規劃不完善、建物機能不符合現代生活需求、建物結構不符合災害防治要求等問題,政府在87年發布「都市更新條例」,期促進都市土地有計畫再開發利用、復甦都市機能、改善居住環境並增進公共利益,惟截至107年底,都更核定件數僅568件,成效不如預期。
為因應國內進入高齡化社會,屋齡逾30年之老舊建物,多未設置昇降設備,無法滿足高齡化社會所需無障礙生活環境,且多有耐震能力不足、違章加蓋嚴重、巷弄狹小、消防設備不完善等問題,政府106年5月發佈《都市危險及老舊建築物加速重建條例》,在住戶100%同意前提下,具備快速通關、獎勵明確、稅賦減免優渥及無最小面積限制等特色,希冀推動危險及老舊建築迅速重建。
考量都市危險及老舊建築物加速重建條例施行期間僅10年,且僅前3年額外提供10%之容積獎勵,為加速危險及老舊建築物重建進程,本文將以住戶、建商、銀行、政府及重建基地周遭民眾等不同利害關係人角度,探討各利害關係人對本項業務之關切議題、思考面向及決策評估模式,並提出結論與建議,期對危險及老舊建築物重建業務推動有所貢獻。
In order to resolve three major issues including the urban development plan not implemented comprehensively in early 80’s of Taiwan, the functionality of building not fitted the needs of modern living style and the building structure not complied with the requirements of disaster prevention, the government enacted the law, the “Renewal of Urban planning” in year 1987. The original thoughts with that law is to accelerate the redevelopment and utilization of urban land; however, the result is not as good as expected. Till the end of year 2018, the number of approved cases was only 568. In response to the development of the ageing population in our country and society, most of old buildings over than 30 years have not been equipped with lifting equipment, which cannot meet the barrier-free living environment required by the aging society. Aside from that, the city also confronts the problem of insufficient earthquake-resistant capabilities, serious illegal rooftop add-ons, narrow streets and inadequate fire-fighting facilities. Under the “Statute for Expediting Reconstruction of Urban Unsafe and Old Buildings” issued by the government in May 2006, its spirit is to speed up reconstruction of unsafe and old buildings in condition to 100% agreed by households, the government will support express services, incentive scheme, tax relief and remove the minimum area limitation. Considering the “Statute for Expediting Reconstruction of Urban Unsafe and Old Buildings” only has been run for 10 years and the 10 % bulk reward offers has just announced 3 years ago, in order to rapidly move on the reconstruction process of unsafe and old buildings, this essay intends to explore the related issues, multifaceted consideration and decision-making assessment models from the perspectives of households, construction companies, banks, the government and the people, those stakeholders of the old building to provide conclusions and recommendations. And, expect contributing to the promotion of the unsafe and old building reconstruction business.
