Abstract

本研究旨在分析探討兩公約於我國國民中學實施現狀與挑戰,包含受訪教師對兩公約的認知情形、教學融入現況、校規的合適性、校園互動及管理層面的現況,並探討兩公約國內法化後於教育現場適用的挑戰。為達研究目的,本研究採深度半結構式訪談,訪談對象為該校五名資深教師,根據訪談結果,五位教師均認同兩公約之人權內涵於國中校園的適用。 依據上述研究目的,本研究得出結論如下: 一、研究對象對於兩公約內涵採正面看法,認同兩公約內容的重要性。 二、課程融入部分,由於教學時間有限及內容繁重,除了公民科外,其餘科目均無融入教學。 三、校規有違背兩公約精神處,但目前為止並未針對校規進行修訂。 四、學校備有許多保障學生權利措施,但利用狀況不普遍 五、教師對於兩公約之認知普遍不足,亦缺乏相關研習講座。 六、校園施行兩公約的挑戰上,主要來源有未能釐清公約權利之界線、學校同仁保守氛圍之壓力、社會輿論及招生因素、學生能動性尚不足等
The thesis aims to analyze and discuss the present situation and challenges of the implementation of the the International Covenant on Civil and Political Rights (ICCPR) and The International Covenant on Economic, Social and Cultural Rights (ICESCR) on Campus in Taiwan , including the status of the teachers' understanding of the ICCPR and ICESCR, the current situation of teaching integration, the legitimacy of school regulations, the status of school’s management. Furtherly, discussing the challenge and problem confronted on campus after human rights protection provisions in the two Covenants have domestic legal status. For the purpose of the thesis, the study conducted a semi-structured interview with five teachers of junior-high school based on qualitative research. From th. According to the interview results, all interviewees agreed that the human rights of the ICCPR and ICESCR were applicable to the junior-high school students. According to the researching purpose above, the results are listed as below: 1.All interviewees take a positive opinion, agree with the importance of the contents of the two conventions. 2.The teaching time of the curriculum is limited and heavy content, in addition to social studies, the rest of the subjects are not integrated into curriculum. 3.The part of school regulations is violated with the two conventions, but so far there’s no revision for the school regulations. 4.The school has a lot of measures to protect student rights, but the use of the situation is not common 5.The teachers for the two conventions generally lack of awareness, but also the lack of relevant seminars. 6.The implementation of the two conventions on the challenges of the campus, the main source has failed to clarify the boundaries of the rights of the law, the pressure of the conservative atmosphere of the school colleagues, public opinion and enrollment factors, student activity is not enough.
