Abstract

本篇研究包含兩部分:即源自歐陸之阻卻違法理論及我國傳統人性思想中有關性惡本質-合理之惡的辯證。採用性惡辯證本質邏輯分析與論證為研究途徑,亦即在研究態度與觀點上係以西方的阻卻違法學理為出發點,並根據西方學者所建構之理論與文獻作為分析的材料,更重要的是突顯中國人特有的人性與人倫觀,特別是以「合理的惡」補中西方法律學理之不足,而合理之惡係就中國傳統文化思維所強調的人性、人倫,加上西方所強調的民主原則的人道、人權之間的調和。雖然西方所強調的民主原則是服從多數與尊重少數,在法理上更需要有人性與人倫基礎,這四者是性惡本質是否合理化思維訴求的判斷標準,因而同時提供特有的辯證思維模式與架構去解析本文所謂的合理之惡的意義,此為本文可能之創見,其終極目標則祈能為推動理想的司法審判貢獻一己之力。
