dc.description.abstract由於原有知識產權法律不適用於數據庫的保護，因此西方國家都在加快相關的立法進程。本文擬採用平衡論的觀點回顧歐盟和美國在數據庫知識產權保護方面的司法 實踐，闡明數據庫知識產權保護立法中的平衡論原則，對我國的數據庫知識產權保護提出建議。zh_tw
dc.description.abstractLacking originality, database could not receive enough protection from present intellectual property law. As a result, western countries are all accelerating the process of legislation. From the view of equilibrium theory, this paper reviews the judicial practice of the database intellectual property protection by EU and USA, formulation the criterion of equilibrium in the legislation of database intellectual property protection, giving some suggestion for database intellectual property protection in China.en_US
