Abstract

摘要 我國大學法在民國八十三年一月五日修正時,做了幾項重大變革,其中與學生事務相關者,為將訓導處更名為學生事務處、學生代表有出席校務會議及與學業、生活及訂定獎懲有關規章會議的權利、保障並輔導學生成立自治團體、建立學生申訴制度…等,也讓各大學院校注意到一直被忽略的教育學習場所「學生宿舍」這個區塊,正是因為如此,各級教育單位開始重視宿舍學生的學習與權利,而宿舍中學生參與自治學習在此就更顯重要,本研究論文旨在從學生自治之角度探討學生宿舍自治組織之功能,透過文獻探討與資料分析,探究學生宿舍自治組織運作機制之法理基礎與意涵,並進而提供檢討與建議事項,期許對落實大學自治理念下的大學生學術自由、學習自由與學生自治,及對學生權利維護、促進學生人格自由開展之教育目標能提供些微貢獻。 基於上述說明,本研究對以下問題加以探討: 一、探討學生自治之意涵。 二、探討學生宿舍自治組織之地位與功能。 三、檢討各大學學生宿舍自治組織辦法現況,以探討理想宿舍自治組織須考量之因素及應發揮之功能。 四、分析各大學學生宿舍自治組織辦法,並檢討缺失。 五、試擬一學生宿舍自治組織辦法的參考模式。 綜合研究結果,提出下列結論: 一、組織辦法完整性的欠缺:學生宿舍自治組織功能和宿舍之間必須要有系統性的關聯。 二、組織職務明確性的瑕疵:各學校對學生宿舍自治組織職務需明確規劃,使每一個組織成員在組織中都能扮演一定的角色功能,才能達到學生樂於參與增進學習的效果。 三、財務支持穩定化的不足:經費充足與否及其來源,對學生宿舍自治組織之運作能否順暢,及是否能不受經費之來源影響其獨立行使職權、不受干預之精神有非常大的影響。 四、宿舍教育功能面的缺乏:學校若能更加理解增進宿舍自治組織功能的種種因素,就更能夠設計出適合學生學習的宿舍自治組織辦法,也就能與學校教育目標相結合。 本研究對學生宿舍自治組織、教育單位建議如下: 壹、宿舍自治組織之建議 一、積極爭取宿舍中學生自治空間。 二、提昇學生宿舍自治參與能力。 三、體認學生宿舍自治組織幹部的責任。 貳、對教育單位之建議 一、訂定促進自治組織發展辦法。 二、建立優質之學習與發展環境。 三、規劃完善周延幹部訓練制度。 四、提昇學務人員專業素質能力。 五、運用網路增進組織效能發揮。 六、發展宿舍為主體之核心課程。 七、推廣宿舍學習護照認證制度。
Abstract The “Law of University” had made some important changes about the student affairs when it revised in January 5, 1994. It contains the change of Student Affairs Division from the Discipline Division; the representatives of students has the right to attend the Administrative Conference and participate the establishment of studies, daily life and the system of rewards and penalties; to ensure and guide the student self-control organizations; to establish the system of complain, etc. Hence, the universities and all levels of schools have noticed the learning, rights and self-control about the dormitory students. This essay is making use of the methods of document analysis to confer the student self-control organizations in the viewpoint of student self-control, and discuss the operational system of student dormitory self-control organizations. Thus, we will take some suggestions those about the academic freedom, liberty to learn, self-control, rights protection and to promote the liberty of personality such as the important ideas under the “Law of University”. This essay confers the following issues on the basis of the previous explanation: 1.The implications of student self-control, 2.The status and capability of the dormitory self-control organizations, 3.Review the laws and regulations of these self-control organizations and discuss the functions of a modeling self-control organization, 4.Analysis the laws and regulations of Taiwan’s universities and review the shortcomings, 5.To draft a model of dormitory self-control organization. This essay also synthesizes the conclusions according to the above-listed studies: 1.The shortages of completeness: it required a systematical connection between the dormitory and self-control organizations, 2.The faults of explicitness about each post: the universities should clear planning each post of the self-control organization to enable each member well done the role-play thus promoting the learning effectiveness, 3.The shortages of financial stability: there are main influence whether the funds sufficiently or a clarify sources to the operations and independence of a self-control organization, 4.The shortages of dormitory’s education: the universities should understand the functions of self-control organization to establish the suitable regulations those connected the goal of university’s educations. The suggestions of this essay for the self-control organizations and educational institutions are below: First, the suggestions for self-control organizations: 1.To strive the self-control space effectively, 2.To promote the capability of self-control participations, 3.To consider the responsibility of a self-control cadre member. Secondly, the suggestions for educational institutions: 1.To establish the regulations of self-control organizational developments. 2.To build up a high quality environment for learning and development, 3.To plan a suitable training system for cadre members, 4.To promote the professional capability of student affairs members, 5.To promote the organizational efficiency on the internet, 6.To develop the core courses on the basis of dormitory, To popularize the approve system of dormitory learning passpo
