dc.description.abstract | 司法通譯的培訓、認證制度良窳是影響語言弱勢者進入訴訟程序時是否保障其受公平審判之重要前提。本研究透過文獻探討、資料分析與訪談等研究方法,以我國司法通譯制度現職通譯、特約通譯,以及非政府組織自行培訓之司法通譯為基礎,分析通譯制度發展之背景、專業能力認證,並選擇美國加州法庭通譯計畫進行制度比較,探討我國政府部門、非政府組織對司法通譯的教育訓練或培訓課程是否足以培養通譯的傳譯專業能力,並輔以南洋台灣姊妹會、台灣司法通譯協會開辦司法通譯課程之培訓經驗,綜合探討臺灣司法通譯培訓課程。 研究結果顯示,我國公部門對現職通譯、特約通譯為集中式2日或3日的法律專業知識學習,訓練時數過於集中,且缺少評量機制,訓練成效較受質疑;非政府組織所舉辦之司法通譯培訓課程則較具有多元性與實用性,除法律知識學習外,亦注重通譯實務模擬的演練,較能提升司法通譯傳譯能力;美國加州法庭通譯在語言專業能力設定、考試、認證與在職訓練等均有一套較完整的指標與規畫可依循,或可做為我國改進司法通譯制度規劃之參考。 | zh_TW |
dc.description.abstract | The training and certification system of judicial interpretation affects whether the language vulnerable people are guaranteed to be subject to a fair trial when they enter the proceedings. Based on the research methods of literature exploration, data analysis and interviews, this study analyzes the background of the development of the translation system and the certification of professional competence based on the current translation of the judicial translation system, the special translation, and the judicial translation of the non-governmental organization self-training. The California court interpreting program is a systematic comparison to explore whether the education and training courses for judicial interpreting in the public and private sectors in Taiwan are sufficient to cultivate the interpreting professional ability of interpreting, and the experiences of training in judicial interpreting courses supplemented by TransAsia Sisters Association (Taiwan) and the Taiwan Judicial Interpreters Association to explore the training process of judicial interpreting in Taiwan. The results of the study show that the public sector in Taiwan has been two-day or three-day studying the legal professional knowledge, and the training hours are too concentrated, and the evaluation mechanism is questionable. The training results are more than questioned. The judicial interpreting training course of the non-governmental organization is more diverse and practical. It focuses on the practice of interpreting practice simulation, which can improve the ability of judicial interpreting. The California court interpreting has a set of language proficiency, examination, certification and on-the-job training. Complete indicators and plans can be followed, or can be used as a reference for improving the planning of judicial interpretation systems in Taiwan. | en_US |
