臺灣男性向同人誌創作者發展現況之探討

Abstract

成人內容產業於世界各地都是非常興盛，臺灣雖然不例外但是法律規範並不明確也不保障成人內容的版權。在這樣的環境下，仍然有創作者默默地創作這類作品。本研究為探討男性向成人內容同人誌創作者在臺灣的環境空間下，是什麼樣的動機才能持續創作下去，因此依照生涯規畫中的自我決定理論，探討這群創作者創作動機中的自我價值與自我決定。本研究將研究對象鎖定在有過1年以上經驗的創作者，依問卷調查法的方式進行調查，再深入訪談11位成人漫畫創作者。透過上述的方法，將創作者的動機分析出來，並且將他們的發展現況與發展經驗一併整理出來。 研究最後發現興趣與嗜好是創作動機的重心，加上讀者的肯定才能支撐著他們持續創作。因為創作者的動機具有高自我決定的因素，所以無論是家庭、社會或法律的阻力都無法影響他們創作的決定。其中面對法律問題，有些創作者認為自己是依法創作販售，卻因為對法律理解不夠深入而觸法，因此對法律產生被壓迫感。在發展現況部分，一些較資深的創作者，對法律的研究較深入者有自己一套創作販售的模式，其模式可歸為三個層面，首先是封面設有成人刊物警語與封書。再來是不可創作具有性暴力、人獸交與亂倫等內容。最後是網路販售須要注意的地方，只要注意這三個步驟基本上就不用擔心誤觸法網。最後創作者是否能持續創作下去，最關鍵的要素還是建立在經濟上，主要經濟收入從何而來是往後能否持續經營的重要關鍵。 Pornography is one of the most popular industries around the world, and Taiwan is no exception. In Taiwan, pornography industry is a gray area, and there is no explicit laws to control or protect its copyright. However, many authors continue to make creation of adult content even under such environment in which authorship and copyright are not protected. In this research, we will discuss the motivation which makes these authors moving forward and continuing creating new works in Taiwan without any protection provided by law. In order to study the self-worth and self-determination from these authors' self identification, intensive interviews with eleven creators who have experience over one year of drawing adult Doujinshi are the main target group of this study, and surveys are applied as the main research approach. Finally, this study discovered that interest and habit are the major motivation for Doujinshi authors, as well as Doujinshi readers' recognition. Many distraction such as family and social factors are hard to stop Doujinshi authors from creating because of these authors' strong determination. Most authors of Doujinshi believe themselves that they followed the publication regulation of pornography, but many of them, in fact, actually didn't. As a result, the insufficient knowledge of pornography publication laws punished them, and such punishment made many of Doujinshi authors believe that law intentionally applied pressure to their creation. On the other hand, experienced authors, during their career development, have three major approaches that prevent punishment. The first one is to use a pornography warning sticker on the book cover, or steal the book to prevent exposure of adult content. Second, these author avoids creating adult content that relates to sensitive topics such as sexual violence or incest. Finally, they are careful to the relative regulation of selling these books online. These methods ensure authors from not breaking the law. Overall, what really determines one author's willingness of creating Doujinshi is the economy factor. In other words, the profit of creating Doujinshi is the key to make them engage in this industry.
