親密關係暴力的權力與控制再辯證

Abstract

我國的婚姻暴力防治發展脈絡主要是由民間的婦女團體發起，關注於女性在親密關係當中所遭受到的暴力與不平等對待。然而在通報進案的被害人當中，並非所有的案件都涉及權力不平等與控制。在實施垂直整合服務方案的時空背景下，社會福利機構以及學者之間，在引述如何看待與詮釋親密關係暴力議題時，愈來愈出現多元的不同看法。回顧國內家庭暴力防治法發展脈絡以及相關文獻，則與反性別壓迫息息相關，係聚焦於父權主義壓迫之下的警醒。 本研究以探討婦保工作者如何進行權控案件的區辨為核心主軸，研究透過質性研究之深度訪談法，以半結構式的訪談大綱訪談台北市、桃園縣共8位實務工作者。研究發現，權控案件依然真實的存在，只是隨著通報進來的案主型態與特性逐漸循著時代的轉變而更趨多元，社會工作者為了在時限內遵照標準化的工作流程處理案件，而不容易對權控案件產生辨識，及因應不同案主的特性來調整處遇介入方式。大量湧進的通報當事者，在家暴法範疇中雖廣泛認為有受暴事實，但卻並非皆為原本婦保工作者所指稱之親密關係暴力中遭受權控之被害人；實務上對暴力本質產生分歧的看法，可能係因未對焦於相同的案主群。 社工員在歷經實務衝擊後，發展出對於不同權控程度的案件經驗學習、以及以安全至上的處遇介入方式，並依此分別提供權控類型與非權控的情境式伴侶暴力類型不同之處遇服務。Marital Violence Prevention Services in Taiwan is mainly initiated by the women's NGO, the purpose is to focus on women in intimate relationships which had been subjected to violence and unequal treatment. However, the victim whom were mandatory reported, not all cases are related to unequal power and control. Between social welfare institutions and scholars, citing issues of violence in the interpretation of intimate relationship, appear increasingly diverse different view. Review of the Domestic Violence Prevention Act of domestic development context and review the relevant literature, it is closely related to the anti-gender oppression. Women's rights movement focused on the alert under patriarchal oppression. This study was to explore how social workers to identify cases of power and control types as the core axis, through qualitative research study of the depth interviews, semi-structured interviews to outline the interview in Taipei, Taoyuan County, a total of eight practitioners. The study found that power and control types of cases are still real existence, just as is mandatory reporting of cases coming in gradually follow the patterns and characteristics of changing times and become more diverse. Social workers in order to comply with a standardized workflow within the time frame to deal with cases, and not easy to identify the type of power and control cases. Thus, according to the needs of different cases to adjust interventions is also not easy. After experiencing a social worker impact on practice, developed for different levels of power and control cases experiential learning, as well as security-based interventions at the event, and so provide different services of the power and control type and situational of partner violence.
