Abstract

本研究所採用的研究方法為訪談法,藉由訪談臺北地區的九名特教組長瞭解國民中學之特教組長面對特殊生家長不同意鑑定安置,據法通報的情形。並探究國民中學之特教組長通報決定的影響因素。最後再根據研究結果,提供相關建議,以俾未來探討此研究領域與相關單位之參考。 本研究所歸納的結論如下: 一、特教組長們對整體條文的理解雖大致相同,但對法條仍不甚熟悉。 二、特教組長對於「主管機關」、「通報」的看法分歧。 三、「家長」為特教組長決定過程中的最具主導性的影響因素。 四、「個人直覺習慣」、「個人的價值信念」、「教育主管機關」為特教組長決定過程中重要影響因素。 五、「個人的知識背景」、「組織的資訊蒐集與管理」之不足,讓特教組長難以做出通報決定。 六、特教組長認為法條與其他規定有所矛盾,且適用此法條之情況甚少。 七、特教組長認為「必要時」、「通報」的相關規範不夠具體明確。 八、特教組長認為法條應存在,且應規定不通報的懲處。 九、特教組長認為法條應規定「必要時」所能採取的相關措施,並提供專業的協調者與家長溝通。 根據上述研究發現與結論,提供相關建議,以供教育主管機關、學校、特教組長、後續研究之參考。
The research method is used in this study for the interview survey. This study interviews Taipei nine junior high school section chiefs of special education to understand whether they informed the higher authorities in accordance with the law or not, when they face special students parents do not agree with the identification or placement. In addition, The study explores the impact of factors such decisions by section chiefs of special education of the junior high school. Finally, This study provides relevant recommendations according to the study results. The conclusions of this study are summarized as follows: 1.Section chiefs of special education understand the statute similarly, but they are still not familiar with the statute. 2. The views of section chiefs of special education for "the competent authorities" and "notification" are different. 3."Parents" is the most dominant factor for section chiefs of specialeducation in the decision process. 4. "The personal experiences intuition habits"," the personal values and beliefs", "the higher authorities" are important influencing factors in the decision-making process for section chiefs of special education. 5.Because of the lack of background knowledge of the individual, the organization's information collection and management, section chiefs of special education are difficult to make informed decision. 6.Section chiefs of special education think the statute are inconsistent with other provisions, and the chance of encountering the situation are rare. 7.Section chiefs of special education consider the "essential", and the relevant norms of the " notification " is not specific enough. 8.Section chiefs of special education think that the statute should exist, and should provide for the punishment of no notification. 9.Section chiefs of special education consider that the statute should provide for "necessary" measures that can be taken, and provide professional coordinator to communicate with parents. According to the research and conclusions, this study provides some recommendations for the educational authorities, the school, section chief of special education, researcher in the future.
