公立中小學學校事故中教師之法律責任分析

Abstract

本文主題為「公立中小學學校事故中教師之法律分析」，面對層出不窮的學校事故，身為一個公立中、小學教師究竟應該負起哪些責任，是本文探討的重心。本文共分八個部分：除緒論、結論外，先論及影響教師責任有無的「教育安全義務」，接著分別以案例、分析併陳的方式，論述教育活動事故、輔導管教不當事故、學生間事故、學校設施事故及外力入侵校園事故中教師的相關責任，並提出「教師責任檢視流程圖」做為基層教師面對事故時釐清所屬責任的參考。

The purpose of this theiss is to investigate the legal responsibility in school accidents of the public elementary, secondary schools' teachers. Because teachers have different status, they have to assume more kinds of legal effects. For instance, teachers are civil servants, they are educational professionals, too. So that teachers must assume tort, criminal and administrative responsibilities. Of course in different school accidents, teachers' responsibilities are also different. There are five situations discussed in the thesis. The situations are educational accidents, corporal punishment, impulse between students, facility accidents and result in bad behaviors of other people.
