Abstract: 體罰是近幾年來在教育單位及社會媒體相當熱門的一個話題,因為嚴禁體罰的正式立法,對於整個教育體制帶來一種不同的風氣與氛圍;體罰的涵蓋範圍與定義很廣,本研究則是將體罰聚焦在不當的利用身體活動來達到懲罰的目的,而體育則是運用身體活動來達到教育的目的,兩者相同之處皆是運用身體的活動來達成各自的目的,不同之處就是目的性的不同,但也因此容易讓大家產生一種模糊的概念,把體罰跟體育活動混為一談;本研究旨在探究雙北市國民中學體育教師在嚴禁體罰立法前與立法後,在體育教學活動上會帶來什麼不同的影響,同時深入了解雙北市國民中學體育教師對嚴禁體罰政策的認知及評價,以及在課程中對於學生發生不當行為之管教方式及體育課程內容,是否因為嚴禁體罰立法前後的不同而有所改變;本研究以雙北市國民中學體育教師為研究參與者,採用質性研究的方法,以半結構式的深度訪談為主,輔以文獻探討分析等方式進行資料蒐集,再根據資料的統整、整理與分析;結果發現嚴禁體罰政策立法前後,對於體育教師在體育課程的純教學上無明顯的影響,但一個完整的體育教學則是包含了班級經營與管教,在管教學生上面則是因為立法的關係產生了負面的影響;因為報章媒體片面不實的報導,也大大的影響到教育基層教師的士氣,多管多錯、少管少錯、不管則就不出錯,此種消極的教學氛圍也逐漸慢慢地浮現出檯面。
Corporal punishment is a very popular topic at educational institutions and social media in recent years. Because of the formal legislation of prohibition in corporal punishment, it brings different atmosphere to the entire education system. The meaning and the definition of corporal punishment cover widely. This study of corporal punishment focuses on the improper use of physical activity to achieve the purpose of punishment. Both corporal punishment and physical education have in common is using physical activity to achieve their purposes. It’s easy to let people confuse corporal punishment with physical education. This study is to investigate the impacts of physical teaching activity between non-legislative and post-legislative of corporal punishment, the teachers’ awareness and understanding of the policy, and the differences in discipline of students’ improper behavior during classes and content of physical education course. In this study , PE teachers participants in junior high schools from Taipei City and New Taipei City .Qualitative research methods are used to gather information. According to data integration, collation and analysis, it is discovered that there is no obvious impact in physical education courses between non-legislation and post-legislation of prohibition in corporal punishment. A complete education includes class management and discipline. However, the legislation of the policy brings negative impact to the discipline on students.
