曾煥鵬姜志剛Chiang, Chih-Kang2019-08-292018-08-212019-08-292018http://etds.lib.ntnu.edu.tw/cgi-bin/gs32/gsweb.cgi?o=dstdcdr&s=id=%22G0004023105%22.&%22.id.&http://rportal.lib.ntnu.edu.tw:80/handle/20.500.12235/92001我國身心障礙者的典型就業服務模式主要有一般性(競爭型)、支持性與庇護性三種。近年來因職場「歧視」、「無障礙空間環境」改善有限,促使如街頭藝人、視障按摩、個人創業等非典型就業服務模式興起。目前新北市推出全國首創的『新北市政府幸福餐車輔導計畫』專案,選定分屬公、私單位管理之五址場域以小規模集市經營型態招商,已為非典型就業服務寫下一頁新猷。 本研究導入『法律賦權』理論四大框架之獲得訴諸公正司法與法治權、勞動權及商業權三個支柱,詳加檢視該計畫是否符應身心障礙者非典型就業權益之議題。本研究採質化研究,運用深度訪談法,針對研究問題透過半結構式題綱,訪談主責官員、學者、專家、身心障礙社團暨附設機構法人代表、身障者及家長等,使用 2018年 MAXQDA 軟體系統分析計畫執行的可行性,期將研究所得結論與建議提供予各縣市政府參酌。There are competitive, supportive and sheltered of typical employments services in our country. Recently, due to the discrimination of workplace and the limited improvement of barrier free environment, the atypical employment model increase, such as busker, blind message and individual start up. The first national wide project originated with New Taipei City’s “Assistance Project of Happy Food Truck in New Taipei City Government” selected five places from public and private sectors to be small type of markets for booth recruitment, it is the latest effort to atypical employment service. The research introduced the four frameworks from “legal empowerment” theory to gain the fair judicial, rule of law, labor rights and commercial rights, to survey atypical employment rights for people with disabilities issues. Furthermore, the research used qualitative research and in-depth interviews to interview the main principal officials, specialists and scholars, legal representatives from welfare for the disabled association, disabled people and their parents by semi-structured interview questions.
