林安邦Lin, An-Pan廖英瑾Liao, Ying-Jin2024-12-172024-02-182024https://etds.lib.ntnu.edu.tw/thesis/detail/9bd207f80ee68dde075a1ca0ce728ac8/http://rportal.lib.ntnu.edu.tw/handle/20.500.12235/122359依據教育部的性別統計,疑似校園性侵害、性騷擾與性霸凌事件與日俱增,自從《性別平等教育法》(Gender Equity Education Act)立法以來,該法明定各級學校應設立「性別平等教育委員會」,學校除了必須提供符合性別平等教育的課程、教材及教學以外,更要求各級學校受理「校園性別事件」(Gender-related incident on campus)時,應依法成立調查小組進行後續調查、處理,並提供相關救濟。另外,該法規定法院對於校園性別事件的事實認定,應審酌「性平會調查報告」(the investigation report provided by its Gender Equity Education Committee),顯見調查報告內容的重要性。本研究聚焦於因校園性別事件而涉訟的大專校院,探究性平會調查報告與行政法院裁判書之間的相關性。為此,本研究整理分析大專校院因校園性別事件涉訟且曾經上訴到最高行政法院的確定裁判書,進而,透過質性研究取徑,邀請性平會承辦人擔任受訪人,瞭解大專校院如何因應因校園性別事件涉訟的法務模式,期以瞭解大專校院因校園性別事件涉訟的現況與挑戰,並提出相關建議。According to the gender statistics from the Ministry of Education, incidents of suspected campus sexual assault, harassment, and bullying are increasing. Since the enactment of the Gender Equity Education Act, the law mandates that all levels of schools establish a “Gender Equity Education Committee”. Schools are required not only to provide courses, materials, and teaching that align with gender equality education but also to establish investigation teams in accordance with the law to continue the investigation and handling of"gender-related incidents on campus" and provide relevant remedies when such incidents occur. Furthermore, the law specifies that the court, in determining the facts of campus gender incidents, should consider the "investigation reports provided by the Gender Equity Education Committee," highlighting the importance of the content of the investigation report. This study focuses on higher education involved in litigation due to gender-related incidents on campus, exploring the correlation betweenthe campus gender equality investigation reports and administrative court judgments.To achieve this, the research organizes and analyzes final judgments from the the Supreme Administrative Court in cases where higher education institutions were litigated for campus gender-related incidents. Furthermore, through a qualitative research approach, the study interviews personnel from Gender Equity Education Committee to understand how higher education respond to legal patterns arising from litigation.
