鄭永康Carlos Tee陳尚偉Chen, Shang-Wei2024-12-172024-09-162024https://etds.lib.ntnu.edu.tw/thesis/detail/fad8381017748be279e5caf45557628c/http://rportal.lib.ntnu.edu.tw/handle/20.500.12235/122959翻譯為不同語言族群間之溝通橋樑,各專業領域之術語及特殊用語之使用習慣隨著文化差異而有所不同。在全球化時代,國內外商業貿易往來頻仍,法律翻譯需求大幅增加並備受重視。法律係由國家制定並明確規範權利與義務,對於規範客體具有強制力及拘束力,用語具有精確性、嚴謹性及專業性等特點,法規譯本品質與受文者「知的權利」息息相關,因此法律翻譯高度要求譯者兼具語言及法律專業知識。臺灣之政府採購法為一項重要且影響深遠的法律,適用全國各機關之工程、財物及勞務採購案,不但建立公開化、合理化、國際化、透明化及公平化的採購制度,更提升採購效率及採購品質。政府採購法英譯本是否能與原文發揮同樣效用並將原文意旨傳達給相關人士,為相當值得重視之議題。本研究以政府採購法及其英譯本為例,首先回顧政府採購法起源及歷程、翻譯產業及政府翻譯需求、法律翻譯、中西方翻譯理論等文獻,探究法律翻譯原則及政府機關法律翻譯現況,試圖釐清影響翻譯品質之潛在因素。再運用德國學者朱莉安·豪斯於1997年提出之翻譯品質評估模式進行文本分析,透過語場、語旨、語式、體裁等層面,分析並指出政府採購法英譯本不符合翻譯品質評估模式及法律翻譯原則之處,探討我國政府機關法規翻譯實務之困難與挑戰並提出改善方法。Translation serves as a bridge for communication between different linguistic groups, and the use of specialized terminology and language varies with cultural differences. In the era of globalization, frequent domestic and international business transactions have increased the demand for legal translation. Laws are established by countries to define rights and obligations clearly, and possess binding power over their citizens. Legal language is characterized by accuracy, stringency, and professionalism. The quality of legal translations is closely related to the recipients' "right to know." Therefore, legal translation requires translators to possess both linguistic expertise and knowledge of law. The ROC Government Procurement Act is an important and far-reaching legislation that applies to procurement of construction work, property, goods and services by all levels of government entities (In this thesis, the term “government entities” is to be construed as including government agencies, public schools and university, as well as state enterprises. It is not tobe confused with how the term is employed in the United States). It not only establishes a procurement system that is open, transparent, fair, rational, and international but also enhances procurement efficiency and quality. The question of whether the English translation of the Government Procurement Act can achieve the same effect as the source text and convey its intended meaning to relevant parties is therefore a matter worthy of significant attention. This thesis focuses on the Government Procurement Act and its English translation as a case study. First, it reviews the origins and development of the Government Procurement Act, and probes into Taiwan’s translation industry and the public sector demand for translation services, legal translation, and Western and Eastern translation theories. It explores legal translation principles and the current status of legal translation in government entities while also aims to identify potential factors affecting translation quality. Second, the study employs the translation quality assessment model proposed by the German scholar Juliane House in 1997 for textual analysis. Through inspection of aspects of the translated text, including field, tenor, mode and genre, it analyzes and identifies problems, specifically where the translation of the Government Procurement Act fails to align with the translation quality assessment model and legal translation principles.
