蔡如音Tsai, Eva王潁瑜Wang, Yin-Yu2025-12-092025-06-202025https://etds.lib.ntnu.edu.tw/thesis/detail/f42d90e71b4a45dd77c8d2d1b8525fd5/http://rportal.lib.ntnu.edu.tw/handle/20.500.12235/124161隨著媒材使用與文化的演進,著作權在歷史中不斷地轉變,創作中的「原創性」,這個原先強調「獨立」、「創新」的精神承諾,也逐漸受到了協作、戲仿或是迷因等當代文化思維的挑戰。短影音作為新興的影音創作形式,不僅存在著更多著作權爭議,同時也因為更加深入的平臺化過程而增添了複雜性。短影音背後的原創性話語是如何被界定的?本研究我們將焦點鎖定在短影音場域中進行二次創作的創作者,透過 7 位創作者的訪談,以及五位短影音頻道主,共十部影片資料的探析,了解其在創作過程中對原創性概念的感知和實踐過程。研究發現,對於這些創作者而言,短影音二次創作的原創性是建立在其作品與原作適當的指涉關係,除了要確保新的二次創作不會偏離原作的核心,又必須在此基礎上引入新創的元素或變化,同時形成再現與詮釋並存的作品。但是另一方面來看,二次創作的過程卻也很大程度受到短影音創作平臺的影響,儘管平臺某部分為這些創作者擔保了正當性,但同時它也限制了其創作形式,再加上平臺的流量需求,反而經常使這些短影音二次創作者陷入更不穩定的勞動結構之中。With the evolution of media usage and cultural dynamics, copyright has continuously transformed throughout history. The notion of"originality" in creative works, originally emphasizing independence and innovation, has been increasingly challenged by contemporary cultural practices such as collaboration, parody, and memes. Short-form videos, as an emerging form of audiovisual creation, not only present more copyright controversies but also introduce complexity due to their deeper platformization. How is the discourse of originality defined in the context of short-form videos? This study focuses on creators engaged in derivative works within the short-form video domain. By conducting interviews with seven creators and analyzing ten videos from five short-form video channels, this research explores how these creators perceive and practice the concept of originality in their creative processes.The findings reveal that for these creators, the originality of short-form video derivative work is based on establishing an appropriate referential relationship with the original work. This involves maintaining the core essence of the original while introducing new creative elements or variations, thereby producing works that coexist as both reinterpretation and representation. However, the process of these derivative works are significantly influenced by the platforms on which short-form videos are produced. Although these platforms provide a degree of legitimacy for creators, they simultaneously constrain creative formats.
