Abstract: 體罰等新聞凸顯學生管教問題背後之教育倫理關係之議題。本文擬闡明現代法律理念,而將其運用於教師管教學生之法理分析。法治理念之傳統與現代、現代法的基本精神、現代法之體系與體制,將為法治教育之內涵。教育的法律性質、教師的教學自主權的限制、教師管教行為與學生之人身自由,將為教育與法治之解析。法治教育(言教),應與教育倫理關係法治化(身教)相結合。「教師輔導與管教學生辦法」將被現代法律體系之原理與原則所分析。「教育基本法」為教育倫理關係法治化開啟了新頁。本文僅從教師之管教行為切入,一窺現代法律體系之肌理,盼現代教師能於言教與身教上,更充分地掌握現代法律之體系與精神。
